Orchard House - Terms and Conditions
- The
property known as Orchard House (the Property) is offered for
holiday rental subject to confirmation by Mr Colin Izat (the
Owner) to the renter (the Client)
- To
reserve the Property the Client should complete and sign the booking
form and return it together with payment of the initial non-refundable
deposit (25% of the total rent due). Following receipt of the booking
form and deposit, the Owner will send a confirmation invoice and
statement. This is the formal acceptance of the booking.
- The
balance of the rent together with the security deposit (see clause 5)
is payable not less than eight weeks before the start of the rental
period. If payment is not received by the due date, the Owner reserves
the right to give notice in writing that the reservation is cancelled.
The client will remain liable to pay the balance of the rent unless
the Owner is able to re-let the Property. In this event, clause 6 of
these booking conditions will apply. Reservations made within eight
weeks of the start of the rental period require full payment at the
time of booking.
- Any
chargeable expenses arising during the rental period (e.g. extra
linen) should be settled locally with the Owners representative before
departure.
- A
security deposit of £200 is required in case of, for example,
damage to property or its contents. However, the sum reserved by this
clause shall not limit the Clients liability to the Owner. The Owner
will account to the Client for the security deposit and refund the
balance due within two weeks after the end of the rental period. This
deposit may be waived at Owners discretion
- Subject
to clauses 2 and 3 above, in the event of a cancellation, refunds of
amounts paid will be made if the Owner is able to re-let the Property,
and any expenses incurred in doing so will be deducted from the
refundable amount. The Client is strongly recommended to arrange a
comprehensive travel insurance policy to include; cancellation cover,
personal belongings, public liability, etc as these are NOT covered by
the Owners insurance.
- The
rental period shall commence at 3-4pm on the first day and finish at
10:00am on the last day. The Owner shall not be obliged to offer the
accommodation before the time stated and the Client shall not be
entitled to remain in occupation after the time stated, unless
authorised by the Owner or the Owners representative.
- The
maximum number to reside in Villa 1 in Orchard House must not exceed
7, and 6 in Villa 2, unless the Owner has given written permission.
- The
Client agrees to be a considerate tenant and to take all reasonable
care of the Property and to leave it in a clean and tidy condition at
the end of the rental period. Although a final clean is included in
our prices, the Owner reserves the right to make a retention from the
security deposit to cover additional cleaning costs if the Client
leaves the Property in an unacceptable condition. The Client also
agrees not to act in any way, which would cause any disturbance to
those residing in neighbouring properties.
- The
Client shall report to the owners agent without delay any defects
in the Property or breakdowns in the equipment, plant, machinery or
appliances in the Property and arrangements for repair and / or
replacement will be made as soon as possible.
- The
Owner shall not be liable to the Client:
- For
any temporary defect or stoppage in the supply of public services
to the Property nor in respect of any equipment, plant machinery
or appliances in the Property.
- For
any loss, damage or injury which is the result of adverse weather
conditions, riot, war, strikes or other matters beyond the control
of the Owner
- For
any loss, damage or inconvenience caused to or suffered by the
Client if the Property shall be destroyed or substantially damaged
before the start of the rental period and in any such event, the
Owner shall, within seven days of notification to the Client,
refund all sums previously paid in respect of the rental period.
- Under
no circumstances shall the Owners liability to the Client exceed the
amount paid to the Owner for the rental period.
- This
contract shall be governed by Scottish law in every particular
including formation and interpretation and shall be deemed to have
been made in Scotland. Any proceedings arising out of or in connection
with this contract may be brought in any court of competent
jurisdiction in Scotland.
Orchard House 3Rs Rules, Roles
and Responsibilities
To ensure everything is clear,
and that there are no misunderstandings with regard to what is supplied in
Orchard House apartments, and what responsibilities we request from our
clients, please read the following:

The apartment(s) will be clean and ready for you on your arrival. There
will be clean bed linen and house towels. There will be a welcome pack of
groceries and soft drinks for your convenience. There will be safety
information and details of all the equipment/appliances in the apartments
plus tourist information and Orchard House tips.
- There is air-conditioning in the living rooms of both houses. The
air-con is metered through a token meter, with 8 hours (2 tokens) per day
being included in the rental price. More tokens may be purchased from the
house manager if desired. Please keep exterior doors and windows closed
while using the air-conditioning.

For your safety there are smoke alarms installed in the living rooms and
kitchens. There are spare batteries for these in the emergencies
kitchen drawer, please let our representative know if you have to change
them (or wish them changed for you) so we can replace them for the safety
of further Clients
- There is a first aid kit in the emergencies drawer in the kitchen,
please inform our representative if you have had to use anything from it
(there is no charge for the odd plaster) so we can keep it fully stocked
for the safety of further clients.

There is a fire extinguisher mounted on the kitchen wall. This is a dry
powder extinguisher and is suitable for use on all types of fires. Please
read the instructions on the extinguisher for use.

There are spare light bulbs, a torch, spare matches and candles in the
emergencies drawer in the kitchen
please replace anything used.

You are responsible for keeping the apartment(s) in a reasonable state.
Please ensure that all rubbish is bagged (some plastic bags supplied) and
that the outdoor bins are lined. The rubbish is collected once a week (see
instructions in villa)

Please do not take interior furniture outside, and ensure that as far as
possible all outdoor cushions, lounger mats or anything else that may be
harmed by the heavy dew (or very occasionally, rain) are put under cover.

Please report at the earliest opportunity any breakages or damage to the
furniture, garden furniture or appliances. We do not charge for the odd
accidental breakage. More serious breakages can be paid for on site to our
representative, or we reserve the right to detract any replacement or
repair costs from the Clients security deposit. If a repair has to be made
we will obtain an estimate, and will bill this to you when it is received.
- Our policy is that if our representative finds any unreported breakages
or damage after you leave we must assume it was caused by the Client.
Having to advise you of breakages or damage after the event can be
embarrassing, and causes administrative costs. The Owner reserves the
right to subtract any such costs from the security deposit.
- You must provide your own beach towels, and please try to shake out any
sand before washing beach towels in the washing machines.
- The kitchen has cooker (bottle gas), microwave, fridge with freezer
compartment, kettle, toaster, all necessary crockery, cutlery, glassware,
kitchen utensils and washing machine.
- The living rooms are equipped with portable TV/VCR, Satellite, Hi-Fi with
CD/Tape/Radio and a selection of books,
games, jigsaws and videos
- There is a steam-iron, ironing board and clothes drier.
- There is a picnic set provided including cool-box, freezer-packs,
thermos flask and plastic cups, plates etc. If you use these please leave
them clean for the next client.
The are also wind-breaks/sun-shades for the beach.
- There is a charcoal barbecue and utensils for each apartment. If you use
the barbecue please leave it clean for the next client. (charcoal is
available at the local shop)
- There are portable/pedestal fans for additional summer comfort. There is
a gas fire (bottle gas) for winter months.
